General

This is the most recent Terms of Service agreement as of January 1, 2017.

IF YOU DO NOT WISH TO ACCEPT ALL TERMS OF SERVICE FOR THE INSTAGAIN SERVICE, THEN PLEASE DO NOT ORDER OR ACCEPT THIS AGREEMENT.


Service

Instagain will only be used for promotional purposes for your account and pictures on Instagram.

Instagain reserves the privilege to promote client’s accounts at least 15 days old and with at least 7 posts.

We require your Instagram credentials to run our service because we need access to your Instagram (User name + Password). Client agrees that will follow Provider’s instructions. To run our service we use your Instagram Login to target your specific target audience to drive traffic to your account. This is a very legitimate marketing method which will increase your exposure and following with real organic followers.

The expected amount of followers, likes and comments is not guaranteed to you in any way. It all depends on the quality and interestingness of your content.

Images liked by Instagain or related services are chosen through hash-tagging – we cannot guarantee photos liked to be of appropriate material. (Example: photos containing nudity with the hash-tags #fitness #nutrition). Provider has right to change agreed contract based on unexpected situations, in this case client must be immediately informed about changes made from Provider’s side. In case of client’s disagreement or eventually cancel of agreement, client must inform provider in 5 days latest, otherwise it is considered that client accept it.


Payment terms

You agree that upon purchasing our services, that you clearly understand and agree what you are purchasing and agree with offered services.Upon a fraudulent attempt to file a dispute, we receive the right, we can cancel immediately the contract and stop the service without any claim to refund of money.

Client will pay ordered service (acc. Price list) via PayPal or via Bank account transfer to following Bank account number of Provider: 2401071319/2010. Client must transfer the money with the following information: Variable symbol (same as order number), IBAN (CZ4520100000002401071319), BIC/SWIFT (FIOBCZPPXXX).


Copyright

You will in no way copy any programming, text or images used on the Instagain website without the written consent of a Instagain representative.


Instagram

You will only use the Instagain website in a manner which follows all agreements made with Instagram on their Terms of Service page.


Reviews & Public Usage

If asked for a Instagain review, we have the rights to utilize reviews publicly on forums, and websites unless specifically asked to remain confidential. We can remove your review if contacted – allow 24 hours and it will be removed.


Liabilities

Instagain is in no way liable for any account suspension or picture deletion done by Instagram.


Disclaimer

Instagain will not be responsible for any damages you or your business may suffer. Instagain makes no guarantees of any kind, expressed or implied for the services we provide. Since Instagain uses the internet to deliver services, we cannot guarantee up time or availability of our website.


Change of Terms and conditions

This Terms of Service is subject to change at any time. Notices of change will be considered given and effective on the date posted on our website (www.instagain.eu). No further notice by Instagain is required upon your continued use of our website or software.


Refund Policy

Client receive the right to require a cancel of service Instagain. Client must to get in touch in this case via email with provider of Instagain service (info@instagain.cz). Provider reserves the right 24 hours for registration of this requirement and eventually approve or disapprove it. In case of approval Instagain service will be automatically shut down next calendar day from delivery of approval to Client. Client will receive on his bank account or PayPal refunded money for each day from time when the service will be shut down till the last day of actually ordered package. (Example: Client ordered package with 30 days of Instagain service, Client’s requirement for cancel will be approved the 16th day, Client will get back money of 13 remaining days of ordered package).

When purchasing a promotion for 90, 180 or 360 days, the buyer is entitled to a refund within 30 days of promotion.

The Client is not entitled to any refund or refund of the promotional period at the cost of the Provider, if the promotion result is lower than the lower ORIENTATION value of the increase mentioned on the Provider’s website, if will be proven that the Client (either in the past or during the Promotion period) purchased instant fake followers.


Privacy Policy

Client agrees to process following personal data by the service provider. Personal data: First name and Lastname, billing address, company name, TAX ID, VAT ID, country, post code, phone number, e-mail address, IP address.

Personal data will be processed for the purposes of keeping Client data in the central domain name registers for the purposes of their (public) disclosure via the Internet in the central domain name registers (since the domain name registration). If the Client does not choose another option, he / she agrees to process his / her personal data also for the purpose of sending information and commercial messages to the Client. Consent to the processing of personal data in its entirety pursuant to this article is not a condition that would in itself prevent the conclusion of the agreement.

The Client acknowledges that in all negotiations with the Provider he is obliged to present his personal data correctly and truthfully and that he is obliged to inform the Provider of any change in his personal data without undue delay.

The Client is responsible for the accuracy of all personal data entered in the registration application. The Client is obliged to notify without undue delay any changes in personal data provided to the Provider.

Personal data will be processed indefinitely. Personal data will be processed in electronic form in an automated manner.

The Client confirms that the personal data provided are accurate and that it has been advised that this is a voluntary provision of personal data.

In case that a client believes that his or her personal data has been processed by the provider of service in violation of law or these terms. Client has the right to:

  • Ask provider for explanation of situation
  • Require the provider to remedy this situation

The Provider has the right to provide adequate information for the provision of the information, not exceeding the costs necessary to provide the information.
